Terms & Conditions.

The terms that govern your access to and use of the AestheticSuite website and platform.

1. Acceptance of These Terms

These Terms & Conditions (“Terms”) are a binding agreement between you and AestheticSuite AI LLC (“AestheticSuite,” “we,” “us,” or “our”) and govern your access to and use of aestheticsuite.ai (the “Site”) and the AestheticSuite platform (the “Service”). By accessing or using the Site or Service, you agree to these Terms. If you are entering into these Terms on behalf of a practice or organization, you represent that you are authorized to bind that entity.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for use by aesthetic practices, their staff, and their patients, and not for any prohibited or unlawful purpose.

3. The Service

AestheticSuite provides software for aesthetic practice management, including patient waitlist and intake management, scheduling, communications, and related features. We may add, change, or remove features over time. Certain features may be governed by a separate written order form or subscription agreement between AestheticSuite and a practice; if there is a conflict, that agreement controls for the subject matter it covers.

4. Accounts and Security

To use certain features you must register for an account. You agree to provide accurate information, to keep your credentials confidential, and to be responsible for activity under your account. Notify us promptly of any unauthorized use or suspected security breach.

5. Acceptable Use

You agree not to:

  • Use the Service in violation of any applicable law or regulation.
  • Upload or transmit malicious code, or attempt to gain unauthorized access to the Service or its related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Access or use another party’s data without authorization, or use the Service to process information you are not permitted to process.
  • Reverse engineer, resell, or use the Service to build a competing product, except as permitted by law.

6. Customer Responsibilities

If you are a practice using the Service, you are responsible for obtaining all necessary patient consents and authorizations, for the accuracy of information you submit, and for using the Service in compliance with HIPAA and other applicable laws. AestheticSuite acts as your business associate with respect to protected health information, as described in our HIPAA Compliance statement and any applicable Business Associate Agreement.

7. Intellectual Property

The Site and Service, including all software, text, graphics, and trademarks, are owned by AestheticSuite or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the data you submit, and grant us the rights needed to provide the Service.

8. Medical Disclaimer

AestheticSuite is a software platform and is not a healthcare provider. The Service does not provide medical advice, diagnosis, or treatment, and nothing on the Site or in the Service is a substitute for the professional judgment of a licensed clinician. Clinical decisions remain the sole responsibility of the practice and its providers.

9. Fees

Access to the Service may require payment of fees as set out in a separate order form or subscription agreement. Unless otherwise stated, fees are non-refundable. Use of the public Site does not require payment.

10. Privacy

Your use of the Site and Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimer of Warranties

Except as expressly stated in a written agreement, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, AestheticSuite will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising out of or related to your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the amounts paid by you to AestheticSuite for the Service in the twelve months preceding the claim, or, where no fees were paid, one hundred U.S. dollars.

13. Indemnification

You agree to indemnify and hold harmless AestheticSuite and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service or violation of these Terms or applicable law.

14. Term and Termination

We may suspend or terminate your access to the Service if you violate these Terms or to protect the Service or its users. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

15. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. The exclusive venue for any dispute will be the state and federal courts located in Utah, unless a separate agreement provides otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site or Service after an update constitutes acceptance of the revised Terms.
